VA Planning
Representing Veterans in Georgia
Many disabled veterans mistakenly believe they are not entitled to VA disability benefits because they weren’t wounded or disabled while serving. However, you may be entitled to a special benefit called Aid and Attendance even if you have a chronic condition that developed after your discharge.
Many disabled veterans struggle with paying for the cost of long-term care. Some find themselves being forced into assisted living facilities because they cannot afford the cost of care in their home. At Turner Law, we provide veterans estate planning services to help you obtain all of the governmental benefits to which you may be entitled. Estate planning lawyer Robert Turner serves veterans and their families in Decatur, the greater Atlanta area and throughout Georgia.
What Is Aid and Attendance and Who Is Eligible?
Aid and Attendance is a special monthly pension available to disabled wartime veterans or their surviving spouses. To be eligible, the veteran must have served at least 90 days of active military duty if that service occurred before 1980, or 24 months of active military duty if that service occurred after 1980 and the veteran must have at least one day of active duty service that occurred during a declared Wartime. The veteran must also receive a discharge that was not dishonorable.
As a veteran, you are considered disabled if you are over age 65, regardless of your health condition. You are also considered disabled if you are considered disabled by the Social Security Administration. Lawyer Robert Turner will help you get started and determine if you are eligible for Aid and Attendance benefits.
Do I Need a Lawyer’s Help to Receive Aid and Attendance?
While you can apply for this special monthly pension on your own, these benefits need to considered as a part of your total estate plan, including any governmental benefits such as Medicaid that you may need now or in the future.
Aid and Attendance benefits could enable you to stay in your home or afford the cost of assisted living. However, without a lawyer to advise you, receiving these benefits could create a penalty period when you apply for government benefits such as Medicaid to pay for nursing home expenses.
At Turner Law, lawyer Robert Turner provides comprehensive estate planning services for veterans and their families that will consider your benefits from all sources.
